Terms of Service

These Terms of Service ("Terms") govern your access to and use of daehnhardt.com and its web application at app.daehnhardt.com (the "Service"), operated by Elena Daehnhardt ("Author", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. Educational Purpose
The Service and all content on it — including books, blog posts, course lessons, code examples, and forum discussions — are provided for educational and informational purposes only. Nothing on this Service constitutes professional, legal, financial, or technical advice for any specific situation. You are responsible for independently verifying any information before relying on it.
2. Intellectual Property
All content published on this Service — including but not limited to text, source code, graphics, PDF books, course materials, lesson scripts, and the daehnhardt.com brand — is the exclusive intellectual property of Elena Daehnhardt and is protected by copyright law (including the Dutch Auteurswet and applicable international treaties such as the Berne Convention and the EU Copyright Directive 2019/790).

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, or sell any content from this Service without prior written permission from the Author, except as expressly permitted below.
3. Permitted Personal Use
If you have purchased a book or course, you are granted a personal, non-exclusive, non-transferable licence to:
- Read, download, and study the purchased content for your own personal learning.
- Run and adapt code examples from the content for your own personal or commercial projects, provided the original book or course is credited.
This licence does not permit:
- Sharing, re-uploading, or forwarding purchased PDFs to others.
- Using content for classroom instruction, corporate training, or any group teaching without a separate written licence.
- Reselling or sublicensing any content.
4. Free Content and Blog Posts
Blog posts and free preview lessons may be shared with proper attribution (name + link to the original post). Copying full articles verbatim for republication is not permitted without written consent.
5. User-Generated Content
By posting in the forum or leaving comments, you grant the Author a non-exclusive, royalty-free licence to display and moderate that content on the Service. You retain ownership of what you write. You are solely responsible for the content you post; do not post content that is unlawful, harassing, defamatory, or infringes a third party's rights.
6. Purchases and Right of Withdrawal
Purchases are processed by third-party payment providers (LemonSqueezy, Stripe). Digital products are delivered immediately upon payment confirmation.
Under the EU Consumer Rights Directive (implemented in the Netherlands in Boek 6 Burgerlijk Wetboek), consumers normally have a 14-day right of withdrawal. For digital content not supplied on a physical medium (e.g. PDF downloads, online courses), this right of withdrawal is waived once performance has begun provided that:
- you have given explicit prior consent to immediate delivery; and
- you have acknowledged that you thereby lose your right of withdrawal.
By completing a purchase on this Service you confirm both conditions. If you did not receive your content or experienced a technical failure, contact us via our contact page within 14 days and we will resolve the issue or issue a refund at our discretion.
7. Disclaimer of Warranties
The Service and all content are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. The Author does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Programming techniques and software libraries described in the content may become outdated; always verify against current official documentation.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Elena Daehnhardt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or the content, including but not limited to loss of data, loss of profits, or any harm resulting from applying techniques or code described in the educational materials — even if the Author has been advised of the possibility of such damages.
The Author's total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific content giving rise to the claim in the six months preceding the claim.
9. Third-Party Links and Services
The Service may link to external websites or use third-party services (Google OAuth, payment processors). The Author is not responsible for the content, privacy practices, or availability of those third-party services.
10. Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, abuse the Service, or engage in fraudulent activity. Upon termination, your access to purchased content may be revoked without refund if the termination is due to a breach of these Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings before your local courts.
For consumers in the EU, the European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution but are willing to seek an amicable solution.
12. Changes to These Terms
We may revise these Terms at any time. The "last updated" date will reflect changes. Continued use of the Service after any revision constitutes your acceptance of the updated Terms.
